REGULATION OF TVDE ACTIVITY - WHAT YOU NEED TO KNOW!

On November 1, 2018, Law no. 45/2018, of August 10 (also commonly known as "Uber Law") came into force, establishing the legal regime for the activity of individual and paid passenger transportation in decharacterised vehicles through an electronic platform (TVDE activity). This law focuses, on the one hand, on the TVDE operator and, on the other hand, on the electronic platforms and respective vehicles and drivers, seeking to harmonize the activity of this service.

The innovations that this law introduces are relevant, since there was no document that met the necessary requirements for the exercise of the activities related to TVDE. The law distinguishes between TVDE operator and electronic platform operator (both requiring licensure from the Institute of Mobility and Transport, I. P.), also making reference to the respective drivers.

As for the TVDE operators and drivers, some of the main novelties are the prohibition of picking up passengers on the public highway or in squares dedicated to the taxi service. Drivers must have a driving license for more than 3 years, category B, endorsement in group 2, as well as the compulsory training course, valid for 5 years and the TVDE driver certificate of the IMT, I. P., valid for 5 years. A very important requirement is the ban on driving more than 10 hours a day (regardless of the number of platforms you work on).

In what concerns the platform operator, in addition to the activity license obtained from the IMT, IP, it shall provide the Mobility and Transport Authority (AMT) with the monthly information on the activity of each driver and each vehicle, as well as making available to passengers who request the service, in reasonable time, information on their prices.

Relating to the passengers, they can request a car capable of transporting passengers with reduced mobility, with the right to equal access to the TVDE services, as well as the possibility of submitting complaints directly in the applications.
