Advertising and Occupation of Public Space
Since Zero Licensing came into force, advertisements of a commercial nature are not subject to licensing or to any other permission, in the following cases:
1. When the commercial advertisements are posted or inscribed on private property and are not visible or audible from the public space;
2. When the commercial advertisements are posted or inscribed on private property and their message advertises the distinctive signs of the establishment’s trade or of the respective owner, or concerns goods or services that are traded in the same building, even if they are visible and audible from the public space;
3. When the commercial advertisements occupy the public space next to the establishment’s façade and advertise the distinctive signs of the establishment’s trade or of the respective owner, or concern goods or services that are traded in the establishment.
Although it is not subject to licensing in the abovementioned situations, placing advertising shall be ruled by the criteria as defined in the Municipal Regulation for Adverting and Occupation of Public Space.
As for the remaining situations regarding placing advertising, i.e. when it is placed on public property or on the private property of others or on any other property than where the commercial establishment is located, they are subject to licensing.
